1. Acceptance of Terms
By accessing or using WAPilot.io ("Services"), you agree to be bound by these Terms & Conditions and our Privacy Policy.
If you do not agree, you must not use the Services.
2. Use of Services
You agree to:
- Use the Services only for lawful, legitimate business purposes
- Comply with all applicable laws and Meta (WhatsApp) policies
- Not misuse, interfere with, or attempt unauthorized access to the Services
Services are intended for users aged 18 years or older. WAPilot.io reserves the right to suspend or terminate access if violations are detected.
3. Prohibited Use, Spam & Abuse
Users may not use the Services for spam, harassment, phishing, fraud, illegal marketing, impersonation, unauthorized communications, or any activity that violates applicable law or Meta policies.
Violation may result in immediate suspension or termination without prior notice, in addition to any action taken by Meta or law enforcement authorities.
4. WhatsApp Business API Compliance
Use of WAPilot.io must comply with all WhatsApp Business API rules, including:
- Valid user opt-in and consent
- Approved message templates where required
- Business-only messaging use cases
Any misuse may result in restrictions or suspension of your WhatsApp Business Account by Meta.
5. AI & Automation
AI and automation features must comply with Meta's WhatsApp Business Messaging Policy and applicable laws.
Automation should be limited to legitimate business use cases such as customer support, lead qualification, notifications, order updates, and FAQs.
WAPilot.io reserves the right to restrict or suspend AI workflows that violate Meta policies, generate spam, impersonation, misleading content, or abusive behavior.
6. Free Trial
Where offered, free trial access (including any "7-Day Free Trial") may be modified, limited, or terminated at any time without notice. Trial features, duration, and eligibility are determined by WAPilot.io at its sole discretion.
7. Intellectual Property
All platform software, branding, logos, and content provided by WAPilot.io are the intellectual property of 7pixs Digital Technologies (OPC) Private Limited and/or its licensors.
You may not copy, modify, distribute, reverse engineer, or misuse any part of the platform without prior written permission.
8. Client Content
You retain ownership of your content.
By using the Services, you grant WAPilot.io a limited, non-exclusive license to host, process, and transmit content solely to provide the Services. This license terminates upon deletion of data, except where retention is required by law.
9. Service Availability
WAPilot.io does not guarantee uninterrupted or error-free availability of the Services. Temporary interruptions may occur due to scheduled maintenance, Meta platform issues, infrastructure failures, third-party outages, or events beyond our reasonable control.
10. Third-Party Services
Certain features rely on third-party providers, including Meta Platforms, Inc. (WhatsApp), cloud hosting providers, payment gateways, and communication infrastructure vendors. WAPilot.io is not responsible for failures, outages, policy changes, or limitations caused by third-party services.
11. Data Security
While WAPilot.io implements reasonable security measures, no online platform can guarantee absolute security. You are responsible for safeguarding your account credentials and for content and data you upload or transmit through the Services.
12. Account Suspension & Termination
WhatsApp Business Account approval, quality rating, messaging limits, and enforcement actions are controlled solely by Meta Platforms, Inc.
WAPilot.io acts as a technology provider and is not responsible for Meta-imposed account restrictions, template rejections, or delivery limitations—even where such actions occur without fault of the client.
We may suspend or terminate your access to WAPilot.io for non-payment, policy violations, abuse, or legal compliance requirements.
13. Limitation of Liability
To the fullest extent permitted by law, WAPilot.io and 7pixs Digital Technologies (OPC) Private Limited shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from:
- WhatsApp or Meta account actions
- Client policy violations or messaging practices
- Service interruptions or third-party failures
- Loss of data, revenue, or business opportunities
14. Pricing, Payments & Refunds
Meta pricing for WhatsApp conversations and WAPilot.io platform subscription fees are separate. Meta may change WhatsApp pricing without notice. WAPilot.io is not responsible for Meta pricing changes.
Subscription fees are non-refundable unless otherwise stated in writing or as specified in our Cancellation & Refund Policy.
Failure to pay applicable fees may result in suspension or termination of Services.
15. Changes to Terms
WAPilot.io may update these Terms & Conditions at any time. Material changes will be posted on this page with an updated date. Continued use of the Services after changes constitutes acceptance of the revised terms.
16. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India.
Any disputes arising from these Terms or use of the Services shall be subject to the exclusive jurisdiction of the courts located in Gujarat, India.
17. Related Policies
Enterprise clients requiring a Data Processing Addendum (DPA), Service Level Agreement (SLA), or Acceptable Use Policy may contact us for customized agreements.
